Section9.6.19 D.3.a prohibits mortgage insurance or other HUD assistance for any residential buildings within 10 feet of an abandoned well that has been certified by the State as safely and permanently abandoned, and within 300 feet of abandoned wells that have not been certified. Therefore, a residential building with an abandoned well under the building cannot be approved for FHA transactions.
Regarding the requirements for hydraulic fracturing well pads at 9.6.19 D.6, these requirements apply to operating or planned well pads. Former well pads should be treated as abandoned wells per 9.6.19 D.3, with the 10-foot or 300-foot buffer applied as described above. |
